WAIVER, RELEASE OF LIABILITY, DISPUTE RESOLUTION, AND INDEMNITY AGREEMENT
Participation in leagues, games, pickup play, open play, training sessions, rentals, tournaments, or the use of any fields, courts, playing surfaces, or facilities (collectively, the “Activities”) is limited to adults. By registering for, booking, organizing, facilitating, captaining, attending, or otherwise participating in the Activities in any capacity, the undersigned acknowledges that participation is voluntary and expressly conditioned upon acceptance of this Agreement.
As a condition of participation, the undersigned agrees that any dispute, claim, or cause of action arising out of or relating to the Activities or this Agreement shall first be submitted to confidential mediation and attempted in good faith before any lawsuit or arbitration is commenced, except where prohibited by law. Such mediation shall take place in the province or state in which the applicable Activity or event occurs.
The undersigned acknowledges that participation in the Activities involves inherent risks, including physical contact, collisions, falls, equipment use, uneven or artificial playing surfaces, weather conditions, and the risk of serious injury, permanent disability, or death, and voluntarily assumes all such risks, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law.
The undersigned further acknowledges that the Activities occur on premises and playing surfaces subject to wear and environmental conditions, and that hazards or defects may exist or arise despite reasonable inspection and maintenance. The undersigned expressly assumes all risks arising from the condition, inspection, maintenance, repair, or use of any facility or playing surface, including risks associated with seams, tears, uneven areas, loose or damaged turf, subsurface conditions, and failure to repair or warn.
To the fullest extent permitted by applicable law, the undersigned waives, releases, and discharges RecRivals LLC, together with all suppliers, vendors, service providers, facility owners, facility operators, municipalities, school boards, landlords, licensors, licensees, affiliated or related entities, and all of their respective owners, officers, directors, employees, contractors, referees, coaches, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all claims, demands, losses, damages, or liabilities arising out of or relating to participation in the Activities or the condition or use of any facility or premises, including claims arising from the ordinary negligence of the Released Parties. This release includes claims for personal injury, medical expenses, rehabilitation costs, lost income, loss of earning capacity, or other economic or non-economic loss. Still, it does not apply to gross negligence or willful misconduct to the extent such liability cannot be excluded by law.
The undersigned acknowledges that participation may occur individually or in association with others, including circumstances in which the undersigned registers, organizes, captains, pays for, or otherwise enables participation by additional persons. Any substitute, guest, or invited participant associated with the undersigned shall be deemed to participate in association with the undersigned for this Agreement.
The undersigned agrees to indemnify and hold harmless the Released Parties from any claims, losses, damages, or expenses, including legal fees, arising out of the undersigned’s participation in the Activities or the participation of any substitute, guest, or invited participant associated with the undersigned, whether or not such person has executed a waiver or release.
This Agreement shall be governed by the laws of the province or state in which the applicable Activity or event occurs, without regard to conflicts of law principles. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.
By accepting this Agreement, the undersigned confirms that they have read and understood it, that they understand they are giving up legal rights, and that they agree to be legally bound by its terms as a condition of participation.
